Opinion
It was necessary to allege in the indictment, and also to prove at the trial, that the corporation alleged to have been injured by the offense of the defendant, was an existing corporation. The evidence wholly fails in this respect. There must be a new trial in the Sessions. •
Judgment reversed, and new trial in the Sessions ordered.
