McMILLAN, Judge.

This cause was remanded with instructions for the Circuit Court of Barbour County to transfer the appellant’s petition to Marion County Circuit Court 682 So.2d 493 (Ala.Crim.App.1996). The Barbour County Circuit Court has now filed its return, which states that the petition was transferred on March 21, 1995. This appeal, therefore, is due to be, and it is hereby, dismissed.

APPEAL DISMISSED.
