Opinion

Judgment as resettled reversed on the law and the facts and a new trial granted, costs to appellant to abide the event, on the ground that the verdict of the jury is against the weight of the credible evidence. Appeal from order denying motion for a new trial on the ground of newly-discovered evidence dismissed. Lazansky, P. J., Kapper, Hagarty, Carswell and Tompkins, JJ., concur.
