Opinion

McAdam, Ch. J.

This cause was first tried in February, 1884, before the court without a jury, and resulted in a judgment in favor of the plaintiffs.

Upon appeal, the judgment was reversed and a new trial ordered, on the ground, that there was not sufficient proof of negligence on the part of the defendants, to charge them with the loss "which the plaintiff suffered. The facts are fully stated in the opinion filed by the general term, February 25, 1885,
