. After Remand from the Supreme Court

MONROE, Judge.

The prior judgment of this court has been reversed by the Supreme Court of Alabama. On remand to this court, and in compliance with the Supreme Court’s opinion in Ex parte City of Gadsden, 718 So.2d 716 (Ala.1998), the judgment of the trial court is reversed. This case is remanded for further [722]*722proceedings consistent with the Supreme Court’s opinion.

REVERSED AND REMANDED.
