GLADNEY, Judge.

This case was regularly fixed for argument and submission on Monday, May 25, 1964. When the case was called for argument appellant had neither filed a brief nor appeared in person or through counsel. Accordingly, the court, pursuant to Rule VII Section Five (b) of the Uniform Rules, Courts of Appeal, 8 LSA-R.S., ordered the appeal dismissed as being abandoned.

Dismissed at appellant’s cost
