After remand from the Supreme Court

MONROE, Judge.

The prior judgment of this court has been affirmed in part and reversed in part by the Supreme Court of Alabama. See Ex parte Lewter, 726 So.2d 603 (Ala.1998). In compliance with the Supreme Court’s opinion, we affirm the judgment in part, reverse it in part, and remand the case.

AFFIRMED IN PART; REVERSED IN PART; AND REMANDED.
