To compel a re-taxation of plaintiff’s costs in a suit commenced against respondent, wberein tbe declaration contained three counts, and plaintiff withdrew bis claim for a recovery under two of tbe counts, and tbe objection was tbat tbe bill as taxed included tbe fees of a witness wbo was called to sustain tbe claim under one of tbe counts withdrawn.

Order to show cause denied March 12, 1896.
