Charles Franklin O'QUINN, Petitioner-Appellant,
v.
Harry ALLSBROOK, Superintendent of Odom Prison, Jackson, NC
Attorney General of North Carolina, Respondents-Appellees.

No. 87-7517.

United States Court of Appeals, Fourth Circuit.

Submitted June 24, 1987.
Decided Oct. 15, 1987.

Charles Franklin O'Quinn, appellant pro se.

Barry Steven McNeill, Assistant Attorney General, for appellees.

Before JAMES DICKSON PHILLIPS, ERVIN, and CHAPMAN, Circuit Judges.

PER CURIAM:

A review of the record and the district court's opinion accepting the magistrate's recommendation discloses that an appeal from its order refusing habeas corpus relief pursuant to 28 U.S.C. Sec. 2254 would be without merit. Because the dispositive issues recently have been decided authoritatively, we deny a certificate of probable cause to appeal, dispense with oral argument, and dismiss the appeal on the reasoning of the district court. O'Quinn v. Allsbrook, C/A No. 86-328-D (M.D.N.C., Jan. 8, 1987).

DISMISSED.
