Charles A. CREIGHTON, Plaintiff--Appellant,
v.
Sewall SMITH, Warden; T. Purnell, Mr., Defendants--Appellees.

No. 94-7149.

United States Court of Appeals, Fourth Circuit.

Submitted: February 16, 1995
Decided: March 14, 1995.

Charles A. Creighton, Appellant Pro Se. John Joseph Curran, Jr., Attorney General, Amy Kushner Kline, OFFICE OF THE ATTORNEY GENERAL OF MARYLAND, Baltimore, MD, for Appellees.

Before HAMILTON and MOTZ, Circuit Judges, and CHAPMAN, Senior Circuit Judge.

PER CURIAM:

Charles A. Creighton appeals from the district court's order denying relief on his 42 U.S.C. Sec. 1983 (1988) complaint. Our review of the record and the district court's opinion accepting the recommendation of the magistrate judge discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. Creighton v. Smith, No. CA-93-2331-HAR (D. Md. Sept. 20, 1994). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.
