Tbe issues in tbis ease are tbe same as those in tbe case of Johns v. Platteville, ante, p. 219, 157 N. W. 761, and tbis case is controlled by tbe decision, in that case, and tbe mandate will therefore be tbe same.

By the Court. — Judgment reversed, and cause remanded for further proceedings in accordance with tbe opinion in Johns v. Platteville, tbe circuit court to assess damages upon tbis record or take further testimony upon that point, as it may determine.
