Opinion
Upon defendant’s statement in open court that his appeal from the judgment has been abandoned, the appeal from the j udgment is dismissed, with costs. The ox’der granting a counsel fee to plaintiff’s attorneys is modified by directing that the same be allowed and paid to the plaintiff, and as so modified affirmed, without costs.- All concurred.
