Spain, J.

Respondent New York State Racing and Wagering Board (hereinafter Board) has general jurisdiction over all horse racing and pari-mutuel betting activities in New York, including off-track betting (see Racing, Pari-Mutuel Wagering and Breeding Law § 101 [1]). As part of that authority, the Board oversees the simulcast of races conducted at New York race tracks (see Racing, Pari-Mutuel Wagering and Breeding Law §§ 1002 [1]; [1045]*10451007-1009).
