In an action to enjoin respondents from instituting condemnation proceedings, order denying appellant’s motion for a temporary injunction and granting respondents’ cross motion to dismiss complaint for insufficiency, and judgment entered in accordance therewith, unanimously affirmed, with one bill of $10 costs and disbursements.
