On Remand from the Supreme Court

CRAWLEY, Judge.

In compliance with the opinion of the Alabama Supreme Court in Ex parte Hooks, 728 So.2d 631 (Ala.1998), the judgment of this court is reversed and the cause is remanded to the Montgomery Circuit Court for reconsideration in light of Ex parte Horn, 718 So.2d 694 (Ala.1998).

REVERSED AND REMANDED.
