MADDOX, Justice.

By denial of certiorari,, we should not be understood as holding that we agree with all the statements made in the opinion of the Court of Civil Appeals 442 So.2d 932 in this case, nor should we be understood as agreeing with the holding in C & S Construction Co. v. Martin, 420 So.2d 788 (Ala.Civ.App.1982), inasmuch as the petitioner did not request this Court to review that opinion and judgment.

WRIT DENIED.
