On consideration, it is ordered and adjudged by this court that the judgment of the Court of Common Pleas, together with 'the judgment of the affirmance of the Circuit Court, be and the same is hereby reversed for errors appearing in the record, and that this case be remanded to the Court of Common Pleas for a new trial, and for further proceeding’s according’ to law.
