Opinion

DAUKSCH, Judge.

Appellant has appealed a partial summary judgment determining, liability in favor of a plaintiff. Fla. R.App. P. 9.130(a)(3)(c)(iv).

Appellee has filed.a confession of error. Based upon this, we reverse the judgment and remand this case to the trial court for further proceedings.

REVERSED and. REMANDED.

HARRIS and PETERSON, JJ., concur.
