Concur: Chief Judge Desmond and Judges Fuud, Burke, Scileppi, Bergan and Keating. Judge Van Voorhis dissents [608]*608and votes to reverse and to declare chapter 440 of the Laws of 1965 unconstitutional as being in violation of section 2 of article VIII of the New York State Constitution for the reasons stated in the dissenting opinion at the Appellate Division.
