— Appeal from an order of the Supreme Court, Erie County (Joseph R. Glownia, J.), entered September 28, 2007 in a legal malpractice action. The order denied the motion of plaintiff for a stay of all proceedings.

It is hereby ordered that said appeal is unanimously dismissed without costs as moot {see Brummer v Barnes Firm, P.C., 56 AD3d 1177 [2008]). Present — Martoche, J.P, Smith, Centra, Peradotto and Pine, JJ.
