Opinion

It is ordered and adjudged by this court, that the judgment of the said court of appeals be and the same is hereby affirmed; the court of appeals was right in sustaining the motion of the defendant in error and dismissing the appeal of said cause to that court for the reason that the appeal bond was not filed within the time prescribed by statute.

Judgment affirmed.
