Opinion
The defendant was indicted for the. offense of an assault with intent to murder, and on thé trial thereof the iury [170]*170found him guilty. A motion was made for a new trial, on the ground that the verdict was contrary to law, and strongly and decidedly against the evidence, which motion the court overruled, and the defendant excepted. After the adjournment of the court, another motion was made for a new trial before Judge Underwood, on the ground of newly discovered evidence since the adjournment of the court, which was overruled, and the defendant exected.
Let the judgment of the court below be affirmed.
