Opinion

Order directing plaintiff to turn over to the receiver 508,000 laths reversed on the law and the facts, with ten dollars costs and disbursements, and motion denied. The plaintiff’s lien upon the merchandise is unaffected by the action it brought for the price and the judgment obtained thereon. (D’Aprile v. Turner-Looker Co., 239 N. Y. 427.) Lazansky, P. J., Young, Kapper, Hagarty and Carswell, JJ., concur.
