PeR Curiam :

This case comes before the court on plaintiff’s motion, filed March 12,1973, for judgment pursuant to Pule 141(b), requesting that the court adopt the recommended decision of Trial Commissioner Lloyd Fletcher filed November 29,1972, under Pule 134(h), as modified by order of February 22,1973, defendant having withdrawn its notice of intention to except thereto. The court has considered the case without oral argument of counsel and since it agrees with the trial commissioner’s recommended decision, as hereinafter set forth,
