Appeal from a judgment of the Supreme Court (Coutant, J.), entered May 28, 1997 in Broome County, upon a verdict rendered in favor of defendant.
Plaintiff commenced this action to recover damages for injuries sustained in an automobile accident which occurred on August 11, 1993. Plaintiff contends that as he proceeded in an easterly direction on State Route 17 in the Town of Windsor, Broome County, he observed a truck enter the intersection of Route 17 and Place Road in front of his automobile.
