Opinion

Judgment affirmed.

Journal entry: This court finds that the commissioners are without lawful authority to make the improvement of the' roads and laterals described and set out in the petition of the plaintiff below filed in the court of common pleas of Paulding county, Ohio, as referred to in the finding of facts made by the circuit court, in one proceeding.
