Opinion

Judgment affirmed, with costs. No opinion. Present — Peek, P. J., Glennon, Dore, Callahan and Van Voorhis, JJ.; Dore and Van Voorhis, JJ., dissent in part and vote to modify by eliminating the $1,121.01 damages awarded to plaintiff arising from the breach of contract, for the reason that the evidence fails to disclose that the minds of the parties met upon the terms of the bargain so as to create an enforcible agreement.
