— Appeal from an order of the Supreme Court, Erie County (Gerald J. Whalen, J.), entered July 13, 2007 in a personal injury action. The order granted the motion of defendant Marion L. Wansart, as administratrix of the estate of Clarence A. Wansart, Jr., deceased, for a directed verdict dismissing plaintiffs causes of action.

It is hereby ordered that the order so appealed from is unanimously affirmed without costs. Present — Hurlbutt, J.E, Centra, Fahey, Pine and Gorski, JJ.
