Opinion

To compel respondent to grant leave to bring suit upon a residuary legatee’s bond for a claim based upon certain notes given by tbe testator in his lifetime, which claim had not been presented to the commissioners of said estate, proved or allowed.

Denied April 28 1893, with costs.
