The snly question necessary to be decided in this case is, whether part of a contract may be assigned, and the as-signee maintain an action therefor,

It ⅛ a settled principle, that an endorsement of part only of a debt is not valid to charge the drawer or acceptor 5 because it would render him liable on one contract to as many actions as the payee or endorser should thing fit — 1 Raym. 360, Salk. 65, Kyd on Exchange 109.

Judgment reversed, &c.
