Opinion
On the court’s own motion as to defendants Charles F. Berlitz and Charles Berlitz International Tours, Ltd., plaintiff’s appeal from an order of the Appellate Division, entered July 2, 1974, is dismissed, without costs, upon the ground that as to these defendants the order appealed from is not a final order within the meaning of the Constitution. (Cohen and Karger, Powers of the New York Court of Appeals, § 43, pp. 169-171.)
