Judgment of the court of appeals reversed and that of the common pleas affirmed.

It is, therefore, ordered and adjudged that the judgment of the court of appeals be, and the same hereby is, reversed and the judgment of the common pleas court is affirmed. — Reporter. Nichols, C. J., Johnson, Donahue and Newman, JJ., concur. Jones and Matthias, JJ., dissent.
