Issue 1: The trial court’s summary judgment should be reversed because appellant exercised due diligence in serving citation when suit was filed four years after the home equity loan was signed, 60 days elapsed to provide appellees with an opportunity to cure, and appellees were served on day 61 after suit was filed. ............................................................ x

Issue 2: If Issue 1 is not granted, the summary judgment order should be reversed because no statute of limitations applies in suits for constitutional violations of home equity loans. The Fifth Circuit incorrectly interpreted Texas state law on this subject in Priester v.
