In an action to recover the amount paid as taxes in the year 1934, by the vendor against the purchaser under a written contract of sale, order dismissing the complaint and granting summary judgment, and judgment entered thereon, unanimously affirmed, with ten dollars costs and disbursements. No opinion. Present — Young, Hagarty, Carswell, Davis and Johnston, JJ.
