Opinion
Held: When the proceedings of a justice of the peace are taken on error to the Court of Common Pleas and the judgment of the justice is reversed, it is the duty of the Common Pleas, under section 532 of the code of civil procedure, to render judgment in favor of the plaintiff in error for the costs that have accrued up to that time, including the costs in the justice’s court.
Motion overruled.
