Morphy, J.

The petition charges that on the 28th of November, 1839, the defendants caused to be sold at public auction the hull, yards, sails, and rigging of the schooner Louisiana, of which the plaintiffs became the purchasers for the sum of one hundred and forty dollars; that in the notices of sale published in the newspapers, it was represented that the hull of the said schooner was wrecked high and dry on the Last Island, sixty miles west of the South West Pass; that there was on board every thing necessary, the sails and rigging having been stowed in the hold for safe keeping; that part of the cargo was on board, and that Captain Auld had left three faithful and trusty men to take care of her,
