To compeTtbe entry, nunc pro tunc, of an order of tbe Probate Court directing an election by tbe guardian of an incompetent widow to take under tbe statute and not under tbe will of ber busband.
■Denied July 28, 1891, without costs, on tbe ground tbat tbe election filed by tbe guardian at tbe proper time was filed witb tbe knowledge and consent of the Probate Court and bad tbe same legal effect as if tbe record thereof bad been made at tbe time tbat said election was filed.
