Opinion
Civilian pay; dismissal. — This case came before the court on plaintiff’s and defendant’s motions for summary judgment. Upon consideration thereof, and oral argument of counsel, the court concluded that plaintiff had failed to show that the action of the Civil Service Commission was arbitrary, capricious or unsupported by substantial evidence, and, on March 23,1962, ordered that the petition be dismissed.
