PROCEDURAL HISTORY

(1) On May 15, 1986, the Board of Supervisors of South Middleton Township denied landowner [16]*16(Mallios, et al.) a conditional use permit under the township zoning ordinance for the development of land Mallios owns in the township.

(2) Pursuant to the Pennsylvania Municipalities Planning Code, Mallios filed a direct appeal to this court of the adverse action taken by the board of supervisors.
