Judgment reversed on the ground that the answer is a cross-petition, setting up an independent cause of action for an accounting between partners, which is cognizable in equity, in the trial of which the parties were not entitled to a jury, and which was therefore appealable. Black, Receiver v. Boyd, 50 Ohio St., 46.

Burket, J., did not sit in the case.
