Opinion
This case is controlled by the decision rendered this day in the case of Bank of Penfield v. Colclough. The plaintiff in error' having obtained a material modification of the judgment, the cost of bringing this case to the Supreme Court will be taxed against the defendant in error.
Judgment affirmed in part and reversed in part.
