On Remand from Alabama Supreme Court

COBB, Judge.

On authority of Ex parte Baker, 780 So.2d 677 (Ala.2000), we reverse the judgment of the circuit court and remand the cause to the Mobile County Circuit Court for proceedings consistent with the Alabama Supreme Court’s opinion.

REVERSED AND REMANDED.
