Baggett Bros. Farm, Inc. v. Altha Farmer Cooperative, Inc.

118 So. 3d 321, 2013 WL 3942926, 2013 Fla. App. LEXIS 12083
District Court of Appeal of Florida·Decided August 1, 2013·No. No. 1D13-2782·Published

Opinion

PER CURIAM.

Because the order on appeal merely determines entitlement to judgment without entering judgment, the order is not final, and the appeal is premature. Monticello Ins. Co. v. Thompson, 743 So.2d 1215 (Fla. 1st DCA 1999). Accordingly, the appeal is dismissed without prejudice to seeking appellate review upon entry of a final order.

VAN NORTWICK, CLARK, and OSTERHAUS, JJ., concur.
