Opinion
Appeal from an order of the Supreme Court, Madison County Special Term, which denied a motion by the defendant-appellant Necrason to dismiss the complaint herein. The action is to recover moneys alleged to have been obtained from the plaintiff by means of fraud and deception on the part of the defendants. The complaint in our opinion states a good cause of action. Order affirmed, with $25 costs and disbursements. All concur.
