Order granting motion of the defendant, a non-resident, to set aside the service of a summons upon him while present in this State for the purpose of acting as a witness in an action, affirmed, with ten dollars costs and disbursements. No opinion. Lazansky, P. J., Hagarty, Davis, Adel and Taylor, JJ., concur.
