P., Cohn, Callahan, Van Voorhis and Shientag, JJ.; Callahan, J., dissents in part and votes to affirm the order and judgment as to the first and second causes of action alleged in the complaint but concurs with the majority of the court in reversing the order and judgment and denying the motion insofar as the third cause of action is concerned.
