Opinion

PROVOSTY, J.

Names and dates changed, this case is identical with that of Anthony J. Dominick v. Detroit Fire & Marine Ins. Co. (No. 23988) 85 South. 236 1, this day decided. For the reasons there given, it is ordered, adjudged, and decreed that the judgment of the district court and that of the Court of Appeal in this case are set aside, and this suit is dismissed at the cost of plaintiff in both courts.
