Collier, James A. Kalicki, and Robin Rumbaugh, in her capacity as 22 Trustee of the Edith and James Harley Trust Dated August 31, 1981, the Edith and James 23 Harley Trust – Survivor’s Trust, and the Edith and James Harley Trust – Residual Trust 24 (collectively, “Parties”, and each, individually, “Party”), in order to protect the confidentiality 25 of any trade secrets, confidential business information, or confidential financial information 26 obtained by the Parties in connection with this case, hereby stipulate and agree as follows: 27 1 1. Any Party or non-party may designate as “CONFIDENTIAL” (by stamping the 2 relevant page or other otherwise set forth herein) any document or response to discovery which 3 that Party or non-party considers in good faith to contain information involving trade secrets, 4 confidential business information, or confidential financial information subject to protection 5 under the Federal Rules of Civil Procedure or Nevada law (“Confidential Information”). 6 Where a document or response consists of more than one page, the first page and each page on 7 which Confidential Information appears shall be so designated. 8 2. A Party or non-party may designate information disclosed during a deposition or 9 in response to written discovery as “CONFIDENTIAL” by so indicating in said response or on 10 the record at the deposition and requesting the preparation of a separate transcript of such 11 material. Additionally, a Party or non-party may designate in writing, within twenty (20) days 12 after receipt of said responses or of the deposition transcript for which the designation is 13 proposed, the specific pages of the transcript and/or specific responses to be treated as 14 Confidential Information. Any other Party may object to such proposal, in writing or on the 15 record. Upon such objection, the Parties shall follow the procedures described in Paragraph 8 16 below. After any designation made according to the procedure set forth in this paragraph, the 17 designated documents or information shall be treated according to the designation until the 18 matter is resolved according to the procedures described in Paragraph 8 below, and counsel for 19 all Parties shall be responsible for marking all previously unmarked copies of the designated 20 material in their possession or control with the specified designation. 21 3. All information produced or exchanged in the course of this litigation (other 22 than information that is publicly available) shall be used by the Party or Parties to whom the 23 information is produced solely in connection with, and for the sole purpose of prosecuting or 24 defending, this litigation. 25 4.
