Opinion

Per Curiam.

The exception to the appointment of viewers before the completion of the canal, is disposed of by the Commonwealth v. M‘Allister.

Such of the other exceptions as have been urged, depend on depositions, which we have determined, perhaps after some contrariety of decision in cases of this kind, to be inadmissible; and this ;.s to be taken for the established practice of the Court.

Proceedings affirmed.
