This court has already passed upon every question involved in this case. See Pike vs. Lytle, 1 English's Rep. 212. We deem it unnecessary to re-argue the points presented as the two cases are precisely analogous, and rest upon the same principles of law. It is all sufficient to refer to the decision in that case for an argument strictly applicable to this. Judgment reversed.
